These terms and conditions set forth are the terms and conditions under which you may use this website. This website offers visitors with the ability to purchase coffee we sell under our private label, Coffee Flamingo. Our third-party production and distribution partner, Coburg Coffee Company (http://www.coburgcoffeecompany.co.uk), processes and distributes purchases made on this website. By accessing or using this website you approve that you have read, understood, and agree to these terms and conditions.
In order to use this website and make purchases, you must be:
- at least sixteen (16) years of age;
- of the legal age of majority in your jurisdiction;
- possess the legal authority;
- making purchases to be shipped to a United Kingdom address;
- right and freedom;
to enter into these terms and conditions as a binding agreement. You are not allowed to use this website if you breach any of the above points, or under any law or regulation applicable to you.
When purchasing a product and/or product subscription, you agree that:
- you are responsible for reading the full product and/or product subscription listing before making a commitment to completing the purchase;
- you enter into a legally binding contract to purchase a product and/or product subscription when you commit to purchasing a product and/or product subscription and you complete the checkout payment process.
The prices we charge for purchasing our products and/or product subscriptions are listed on the website. We reserve the right to change our prices for products and/or product subscriptions displayed at any time, and to correct pricing errors that may inadvertently occur. The fee for the product subscription purchased and any other charges you may incur in connection with your use of the product subscriptions, such as taxes and possible transaction fees, will be charged to the payment method you used to complete the purchase, at the same frequency as the product subscription you purchased.
Unfortunately, due to the nature of our products and the production process we cannot offer returns. In the event that your order wasn’t fulfilled correctly or there was an error in the fulfilment process we may offer a refund, account credit or a like for like product replacement. To submit a product replacement request please email us at coffeeflamingo@outlook.com within eighteen (18) days of the date you purchased the product and/or product subscription. When we receive a valid product replacement request for a product purchased from the website, we will take full responsibility for the resolution of the product replacement request. If we are unable to resolve the product replacement request within a reasonable time, you will be entitled to a full refund of the monies paid for the product.
We may, without prior notice:
- change products and/or product subscriptions;
- stop providing products and/or product subscriptions or any features of the products and/or product subscriptions available on the website;
- or create limits for the products and/or product subscriptions available on the website.
We may permanently or temporarily terminate or suspend access to products and/or product subscriptions without notice and liability for any reason, or for no reason.
The website and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, website marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Daniel Whitman and James Jebb, co-owners of Coffee Flamingo. Except as explicitly provided herein, nothing in these terms and conditions shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
We may permanently or temporarily terminate or suspend your access to this website without notice and liability for any reason, including if in our sole determination you violate any provision of these terms and conditions, or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any product subscription at any time. If you are wanting to cancel a product subscription, you must notify us ten (10) days before your next product subscription payment is due, by emailing coffeeflamingo@outlook.com.
You agree to indemnify and hold Daniel Whitman and James Jebb, co-owners of Coffee Flamingo, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third-party due to, or arising out of, or in connection with your use of the website.
To the maximum extent permitted by applicable law, in no event shall Daniel Whitman and James Jebb, co-owners of Coffee Flamingo, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the website.
To the maximum extent permitted by applicable law, Daniel Whitman and James Jebb, co-owners of Coffee Flamingo, assumes no liability or responsibility for any:

Your continued use of the website or after any such change constitutes your acceptance of the new terms and conditions. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the United Kingdom. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
